Is it a good idea to divorce online?

Nowadays, we can accomplish almost everything online. If someone can start a romance using their smartphone, it stands to reason that they can also stop a relationship or their marriage with the same device, right? But should you get a divorce lawyer in Delhi?

Is it legal to divorce online?

Online divorces are undoubtedly legal, but they are not usually advised, particularly if you and your spouse are going through a contested divorce. If you and your spouse cannot agree on all significant matters, you should consult with an attorney.

Working with a divorce attorney

If you are considering divorce, you should consult with an attorney who will take a personal interest in your case and advise you on what you could face in terms of property distribution, child support and custody, and alimony. They will be able to provide you with advice on your alternatives. As you try to terminate your marriage, an attorney will give support and direction.

Divorce type

Mutual

Section 13-b of the Hindu marriage act governs mutual divorce.

A mutual or uncontested divorce is a form of divorce in which both spouses are fairly sorted on reasons such as

1. Properties

2. Assets

3. Child custody

4. Investments

5. Alimony

There is no fighting between spouses in an uncontested divorce for the reasons outlined above. The parties, namely the husband and wife, reach an agreement and continue with the divorce calmly.

Contested

An uncontested divorce is the polar opposite of a disputed divorce. Throughout the operation, there is a lot of stress between the spouses.

The reasons for pursuing a disputed divorce are specified in section 13 of the Hindu marriage act, 1955, and are given below.

1. The partner’s unsound mentality

2. Highly communicable illness

3. Leprosy

4. Haven’t heard from the partner in over 7 years.

5. Desertion

6. Cruelty

7. Adultery

8. Religious conversion

The time taken to get a divorce decree

A consensual divorce often takes 18 to 24 months to complete. However, no petition may be filed until one year has passed after the marriage.

The first motion will be submitted, and the court will then instruct the parties to wait 6 months before filing the second move. And the divorce decree will be issued by the court.

However, in a contentious divorce, the procedure may take longer since both parties have not agreed on many topics and it will take time to reach an agreement. Because the nature of these types of cases is intricate, a disputed divorce may take 3-5 years. Furthermore, if either party is dissatisfied with the result, they can appeal to the high court or Supreme Court and challenge the lower court’s decision.

Conclusion

The whole divorce process is very emotionally and intellectually draining. However, hiring a qualified and experienced divorce lawyer might spare you a lot of mental anguish. Through their expertise, they can assist you in bringing the most advantages.
